Welcome to BeAlive! These terms and conditions (the "Terms of Service" or "Terms") apply to your use of this store and website, including all related information, content, features, tools, products and services (the "Services"), operated by:

The terms "we", "us" and "our" refer to BeAlive. Our store is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Nothing in these Terms affects your statutory rights as a consumer under Belgian and European Union law, including the legal guarantee of conformity and the right of withdrawal. Where any provision of these Terms conflicts with mandatory consumer protection law, that law prevails.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you use the Services under the supervision of a parent or legal guardian who agrees to these Terms.

To use the Services, including purchasing products, you may be asked to provide information such as your email address, billing, payment and shipping details. You warrant that all information you provide is correct, current and complete. You are responsible for keeping your account credentials secure and for all activity on your account.

SECTION 2 — OUR PRODUCTS

We make every effort to represent our products accurately in our online store. However, colours and product appearance may differ slightly from how they appear on your screen, depending on your device and settings. Product descriptions may be updated at any time. We reserve the right to discontinue any product and to limit quantities per order where reasonably justified.

SECTION 3 — ORDERS

When you place an order, you make an offer to purchase. A contract is concluded when we confirm acceptance of your order by email. We reserve the right to refuse an order for legitimate reasons — for example, suspected fraud, unavailability of stock, or an obvious error in price or product information — in which case we will notify you and refund any payment already made.

Your purchases may be returned or exchanged in accordance with our Refund Policy [LINK] and your legal right of withdrawal (see Section 5).

You confirm that your purchases are for personal or household use and not for commercial resale.

SECTION 4 — PRICES AND PAYMENT

All prices shown in our store are in euros and include VAT. Shipping costs, where applicable, are shown separately at checkout before you confirm your order. For deliveries outside the European Union, import duties, taxes or handling fees may be charged by your local customs authority; these are payable by you.

Prices, discounts and promotions may change at any time, but the price charged is always the price in effect at the moment you place your order, as confirmed in your order confirmation email. If a promotion has its own terms, those terms apply to that promotion.

You agree to provide accurate and complete payment information and confirm that you are authorised to use the chosen payment method.

SECTION 5 — RIGHT OF WITHDRAWAL AND LEGAL GUARANTEE

As a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, and a further 14 days to return the products. The full procedure and conditions are described in our Refund Policy.

In addition, all our products are covered by the legal guarantee of conformity of two years under Belgian and EU law. If a product proves defective or does not conform to the contract, contact us at info@bealive.one and we will repair, replace or refund it in accordance with the law, at no cost to you.

SECTION 6 — SHIPPING AND DELIVERY

Delivery times communicated in our store are estimates. We are not responsible for delays caused by carriers, customs processing or events outside our reasonable control, but we will always assist you in resolving any delivery issue. The risk of loss or damage passes to you at the moment you (or a third party designated by you, other than the carrier) physically receive the products.

SECTION 7 — INTELLECTUAL PROPERTY

The Services, including all trademarks, brand names, text, images, graphics, video, audio and their design, selection and arrangement, are owned by BeAlive, its affiliates or licensors and are protected by Belgian, European and international intellectual property law.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish or transmit any material from the Services without our prior written consent. BeAlive's names, logos, product names, designs and slogans are trademarks of BeAlive. Shopify's name and logo are trademarks of Shopify. All other trademarks belong to their respective owners.

SECTION 8 — THIRD-PARTY TOOLS AND LINKS

The Services may give you access to third-party tools or contain links to third-party websites over which we have no control. We provide such access "as is", without warranties of any kind, and we are not responsible for the content, accuracy or practices of third parties. Use of third-party tools and websites is at your own risk; please review the relevant third party's terms and policies.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify, but all sales and purchases in our store are made directly with BeAlive. Shopify is not a party to, and is not responsible for, any transaction between you and BeAlive.

SECTION 10 — PRIVACY

All personal information we collect through the Services is processed in accordance with our Privacy Policy [LINK] and applicable data protection law, including the GDPR. Because the Services are hosted by Shopify, certain personal information is also processed by Shopify in order to provide and improve the Services; see Shopify's privacy policy for details.

SECTION 11 — REVIEWS AND FEEDBACK

If you submit reviews, suggestions, ideas or other content ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce, publish and display that Feedback, including for promotional purposes. You warrant that your Feedback is your own, is accurate, is not unlawful, offensive or misleading, and does not infringe the rights of any third party, and that you have disclosed any compensation received in connection with it. We may remove Feedback that violates these Terms.

SECTION 12 — ERRORS AND OMISSIONS

Occasionally, information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We reserve the right to correct such errors and to cancel orders based on manifestly incorrect information (such as an obviously wrong price), in which case any payment already made will be refunded in full.

SECTION 13 — PROHIBITED USES

You may use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to infringe intellectual property or other rights; (c) to harass, abuse or harm others; (d) to transmit false or misleading information, spam or malicious code; (e) to scrape, crawl or collect personal data of others; or (f) to interfere with or circumvent the security of the Services. We may suspend or terminate your access if you violate these Terms.

SECTION 14 — DISCLAIMER AND LIMITATION OF LIABILITY

The information in the Services is provided for general information purposes. To the extent permitted by law, the Services are provided "as is" and "as available", and we do not guarantee that your use of the Services will be uninterrupted or error-free.

To the fullest extent permitted by applicable law, BeAlive shall not be liable for indirect or consequential damages arising from your use of the Services. Our total liability for any claim relating to a purchase shall not exceed the amount you paid for the product(s) concerned. This limitation does not apply in cases of fraud, wilful misconduct or gross negligence, in the event of death or personal injury caused by our fault, or where it would limit your mandatory rights as a consumer, including under the legal guarantee of conformity.

SECTION 15 — INDEMNIFICATION

You agree to indemnify and hold harmless BeAlive and its partners, employees and service providers from claims by third parties arising from your breach of these Terms or your violation of any law or third-party rights, except to the extent such indemnification would be contrary to mandatory consumer protection law.

SECTION 16 — SEVERABILITY, WAIVER AND ENTIRE AGREEMENT

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision does not constitute a waiver of it. These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding the Services.

SECTION 17 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations, for example in the context of a business transfer, provided this does not reduce your rights as a consumer.

SECTION 18 — GOVERNING LAW AND DISPUTES

These Terms and all purchases made through the Services are governed by Belgian law. If you are a consumer residing in another EU member state, you also retain the protection of the mandatory consumer law of your country of residence.

Any dispute that cannot be resolved amicably shall be submitted to the competent courts of the judicial district of Ghent, Belgium, without prejudice to mandatory rules of jurisdiction that allow consumers to bring proceedings before the courts of their own domicile.

The most current version of these Terms is always available on this page. We may update these Terms from time to time by posting the updated version on our website. Material changes will be notified in accordance with applicable law. Changes apply to orders placed after their effective date; the version in force at the time of your order applies to that order.
